Types of Room Rental Agreements

• Room rental agreement: A legally binding contract between a live-in landlord and a tenant outlining the terms and conditions of renting the room.
• Roommate agreement: An agreement, typically non-legally binding, between co-tenants that guides the responsibilities of each party.

Breaching Contract

Failure to pay: Once a rent payment is late, Iowa landlords may issue a 3-day notice to Pay or Quit (Iowa Code § 562A.27).

Lease violations: If a tenant violates the lease, the landlord may issue a 7-day notice to Cure or Quit(Iowa Code § 562A.27).

Lease abandonment: In Iowa, if a tenant vacates their lease early without just cause, they may be responsible for paying the remaining rent left on the lease until the unit is re-rented.

Self-help evictions: Self-help evictions are illegal in Iowa. Landlords are not permitted to attempt to remove a tenant on their own by changing the locks, turning off utilities, or taking similar actions that may force the tenant to vacate.

Immediate access: In the event of an emergency, landlords have the right to enter a rented room without any notice (Iowa Code § 562A.19).

Landlord harassment: In Iowa, tenants have the right to quiet enjoyment of their home, even if that includes a room within the landlord’s property. Anything that prevents this, including repeated and unnecessary entries into the rented room, can constitute harassment.

Advance notice: Barring any emergency, Iowa landlords must provide tenants with 24 hours’ notice before entering a rented room (Iowa Code § 562A.19).
