Types of Room Rental Agreements
- Room rental agreement: A legally binding contract between a live-in landlord and a tenant outlining the terms and conditions of renting the room.
- Roommate agreement: An agreement, typically non-legally binding, between co-tenants that guides the responsibilities of each party.
Breaching Contract
Failure to pay: Failure to pay rent is a clear breach of your Michigan room rental agreement. If your tenant does not pay rent as outlined, you may issue a 7-day notice to pay or quit (MCL 554.134).
Lease violations: If your tenant violates the terms of your room rental agreement, Michigan law allows you to deliver a month’s notice to cure the violation or to quit the premises (MCL 554.134). If the tenant creates a material health or safety violation, however, you may deliver a 7-day notice to quit (MCL 600.5714).
Lease abandonment: Michigan law outlines several circumstances in which a tenant may break their lease early and move out without penalty, including beginning active-duty military service (Servicemembers Civil Relief Act 50 USC App § 535), becoming incapable of living independently (MCL 554.601a), or being a victim of sexual assault, domestic violence, or stalking (MCL 554.601b).
In other instances, however, a tenant may be responsible for paying out the remainder of the lease.
Self-help evictions: Unlike most other states, Michigan allows landlords to use self-help evictions to remove squatters, but you must seek legal resources first (Act No. 223).
Landlord Room Access Laws
Immediate access: Michigan law does not require landlords to provide notice before entering their rental property.
Landlord harassment: Although there are no laws governing a landlord’s immediate access to their property, repeated misuse of this privilege may constitute landlord harassment, which is illegal and can give the tenant the right to terminate a Michigan room rental agreement early.
Advance notice: Michigan law does not regulate the amount of notice a landlord must give a tenant to enter the property; however, to maintain a good relationship with your tenant, we recommend providing at least 24 hours’ notice.
