Types of Room Rental Agreements
- Room rental agreement: A legally binding contract between a live-in landlord and a tenant outlining the terms and conditions of renting the room.
- Roommate agreement: An agreement, typically non-legally binding, between co-tenants that guides the responsibilities of each party.
Breaching Contract
Failure to pay: If a tenant fails to pay rent, the landlord can issue a 3-day Notice to Pay or Vacate. If the tenant does not comply within that period, the landlord may file for eviction through the court system (NMSA § 47-8-33(D)).
Lease violations: For other breaches, such as unauthorized occupants, property damage, or breaking house rules, the landlord must provide a 7-day written notice describing the breach. In many cases, the tenant has 7 days to correct the issue or vacate the premises. If the tenant fails to correct the violation or repeats it, the landlord may proceed with eviction (NMSA § 47-8-33(A)). Certain illegal activities may allow immediate termination.
Lease abandonment: If a tenant abandons the rental without notice or stops paying rent, the landlord must make a reasonable effort to re-rent the property. The landlord may recover unpaid rent and damages, but cannot collect rent from two tenants for the same period. If belongings are left behind, the landlord must provide written notice and store the property for at least 14 days before disposing of it (NMSA § 47-8-34.1).
Self-help evictions: New Mexico law strictly prohibits landlords from removing tenants without a court order. Actions such as changing locks, shutting off utilities, or harassing tenants to force them out are illegal and can result in legal penalties for the landlord (NMSA § 47-8-36).
Room Rental Landlord Access Laws
Immediate access: A landlord may enter a rental unit without advance notice only in true emergencies, such as a fire, flooding, or a dangerous gas leak that poses an immediate threat to the safety of tenants or the property (NMSA § 47-8-24(B)).
Landlord harassment: Tenants in New Mexico have the right to the quiet enjoyment of their rental. Landlords cannot misuse their right of entry to harass, intimidate, or repeatedly disrupt tenants. Entry at unreasonable times or without valid cause may be considered harassment under state law (NMSA § 47-8-24(F)).
Advance notice: For non-emergency reasons, such as repairs, inspections, or showing the unit to prospective renters, landlords must give at least 24 hours’ notice before entering. Entry must occur at reasonable times and for legitimate purposes. The only exceptions are when the tenant agrees to shorter notice or waives it in writing (NMSA § 47-8-24(A)).
