Types of Room Rental Agreements
- Room rental agreement: A binding agreement between a live-in landlord and tenant that specifies the rules and conditions for renting a room.

Breaching Contract
Failure to pay: When a tenant fails to pay rent, landlords may begin eviction proceedings by serving a Notice to Quit once the 5-day grace period passes (NJ Stat. § 2A:18-61.1).
Lease violations: If tenants break the terms of the lease, landlords may start the eviction process by delivering a Notice to Quit (NJ Stat. § 2A:18-61.1).
Lease abandonment: If a tenant moves out of a rented room before the lease ends, the landlord must make reasonable efforts to re-rent the room and reduce losses. If no replacement tenant is found, the original tenant remains responsible for the rent owed for the rest of the lease term (Sommer v. Kridel).
Self-help evictions: Landlords cannot change locks, shut off utilities, or physically remove a tenant without a court order. New Jersey law considers these actions illegal self-help evictions.
Landlord Room Access Laws
Immediate access: Immediate access to a rented room is allowed when conditions pose a threat to the health or safety of the occupant or others in the building (NJ Ad. Code 5:10-1.1 et seq.).
Landlord harassment: Repeated, unnecessary entries or entries made without notice when not urgent may be considered landlord harassment, and could allow the tenant to break the lease early without fear of legal repercussions.
Advance notice: New Jersey landlords generally cannot enter a rented room without the tenant’s consent or a court order (NJ Stat. § 2A:39-1).
