Types of Room Rental Agreements
- Room rental agreement: A legally binding contract between a live-in landlord and a tenant outlining the terms and conditions of renting the room.
- Roommate agreement: An agreement, typically non-legally binding, between co-tenants that guides the responsibilities of each party.
Breaching Contract
Missed rent payment: If a tenant fails to pay rent, the landlord may issue them a Five-Day Notice to Pay or Quit, which starts the eviction process (VA Code § 55.1-1245(F)).
Lease violation: For health or safety violations, the landlord may simultaneously issue the tenant a 21-day Notice to Cure and a 30-day Notice to Quit. If the tenant does not correct the issue within 21 days, the landlord can terminate the lease on day 30. The landlord can issue the tenant a 30-day Notice to Quit for non-curable contract breaches or repeat violations. If the breach involves criminal activity, the landlord does not have to give notice and may terminate the lease immediately (VA Code § 55.1-1245).
Self-help evictions: Landlords cannot attempt to self-evict tenants by changing locks, turning off utilities, or pressuring them to leave in any other way. Self-help evictions are illegal in every U.S. state.
Landlord Room Access Laws
Advance notice: Landlords must provide tenants with at least 72 hours of notice before entering a rental room for routine maintenance and 24 hours for tenant-requested repairs (VA Code § 55.1-1229(4)).
Immediate access: In the case of an emergency, the landlord may enter the rental room without providing advance notice (VA Code § 55.1-1229(4)).
Landlord harassment: Landlords may not enter a tenant’s room repeatedly without proper advance permission or notice. If they do so, the tenant may have the right to terminate the lease early or pursue legal action against the landlord (VA Code § 55.1-1210).
