Types of Room Rental Agreements
There are a few different types of agreements to consider when creating a room rental agreement in Idaho.
Room rental agreement: A legally binding contract between a live-in landlord and a tenant outlining the terms and conditions of renting the room.
Roommate agreement: An agreement, typically non-legally binding, between co-tenants that guides the responsibilities of each party.
Breaching Contact
Failure to pay: If a tenant fails to pay rent, Idaho landlords may issue a 3-day Notice to Pay or Quit (Idaho Code § 6-303(2)).
Lease violations: In most situations, if a tenant violates their lease, the landlord may issue a 3-day Notice to Cure or Quit. However, if the tenant causes significant property damage or subleases the unit without permission, the landlord may issue a 3-day Notice to Quit (Idaho Code § 6-303).
Lease abandonment: If a tenant tries to leave a lease early without just cause, they could be held responsible for the balance of the lease, loss of the security deposit, and civil lawsuits.
Self-help evictions: Idaho landlords should never attempt to remove a tenant on their own, otherwise known as a self-help eviction. Always follow the legal eviction process when removing a tenant.
Landlord Room Access Laws
Immediate access: In the event of an emergency, landlords may enter the room without advance notice.
Landlord harassment: If a landlord enters the room too frequently and/or without a valid reason, a court may consider it harassment. In this case, a tenant can petition the court to ban the landlord from entering, recoup their court fees, and possibly even terminate the lease early without penalty (ID Code § 6-324).
Advance notice: No law states a landlord must give their tenant advance notice before entering the room. However, it’s considered best practice to give reasonable notice and to only enter for valid reasons, such as a property inspection, repairs/maintenance, or emergencies.
